Acceptance of Terms

PresEngage® (“Company,” “us,” “we,” or PresEngage, Inc.) provides the https://presengage.com website (“Site”) subject to your compliance with these Terms of Use (“Terms”) and any other written agreements between you and us. We reserve the right to modify these Terms at any time. It is your responsibility to review these Terms periodically. Your continued use of this Site constitutes your acknowledgment and acceptance of the updated Terms.

For clarity, and as used throughout these Terms, “Site” means not only presengage.com but also the PresEngage application at presengage.com/app, the audience experience at ask.presengage.com, our other subdomains, and the meeting-platform panels through which the service is delivered (together, the “Services”). These Terms apply both to presenters who hold accounts and to audience members who take part in a presenter’s session, whether or not they have an account.

BY USING THIS SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT USE THIS SITE.

Presenter Accounts and Audience Users

Two very different kinds of people use the Services, and different terms apply to each.

Presenters

A presenter registers for an account. You agree to give accurate registration details, to keep them current, and to keep your login credentials secure — you are responsible for what happens under your account (see Privacy & Security below).

You keep ownership of the decks, documents, and other content you upload. Uploading it grants us only the permission we need to run the Services for you: to prepare your AI Co-Presenter from that content and to answer your audience’s questions from it. We claim no ownership of it and use it for no other purpose. You are responsible for having the right to upload and share what you upload, and for the messages you send your audience — including obtaining any consent the law requires before contacting them.

Subscription fees for paid plans are handled through the third-party payment providers described under Payment.

Audience members

Audience members need no account and pay nothing. You join a presenter’s session with a link, a QR code, an event code, or a panel inside the meeting platform the presenter is using. Some presenters additionally enable an optional text-message add-on for in-person rooms; if you took part in a session that way, the Messaging Terms (SMS and WhatsApp) below apply to you in full.

Joining gives you a limited, personal, non-transferable permission to take part in that session: to ask questions and to view what the presenter chooses to share. It gives you no rights in the presenter’s content beyond that session, and no right to record, republish, or resell it.

Questions you ask are visible to the presenter, and may be shown to the rest of the room where the presenter chooses to display them. Ask accordingly. You agree not to submit anything unlawful, harassing, hateful, deceptive, or infringing; not to impersonate another person; not to submit someone else’s personal information; and not to attempt to manipulate the AI Co-Presenter into producing such content. We and the presenter may remove any question and may restrict access for misuse.

Answers are generated from the presenter’s own uploaded content and are not guaranteed to be accurate or complete. Verify anything that matters with the presenter.

What we collect from audience members, who controls it, who it is shared with, and how to stop our emails are set out in our Privacy Policy — see “Information We Collect From Presentation Audiences,” “How Audience Information Is Used,” “Who Controls Audience Information,” and “Your Choices.”

Content Storage, Retention, and Deletion

1. Your Content. “Presenter Content” means the presentation files you upload and the materials the Services generate from them, including rendered slide images, extracted and formatted text, AI-generated content (such as answers, notes, audio, and video), search indexes, and share links or QR codes associated with a presentation.
2. Automatic archiving of inactive presentations. To keep the Services fast and cost-efficient, presentations that show no activity — no audience questions, no content views, no edits, and no other engagement — for thirty (30) consecutive days may be automatically archived. Before archiving, we will notify you at the email address on your account and give you a one-click option to keep the presentation active. A presentation scheduled for a future talk date you have provided will not be archived before that date.
3. What archiving means. When a presentation is archived, the generated materials described in paragraph 1 above are deleted from active storage, and your original uploaded file is retained in long-term storage. An archived presentation can be reactivated from your dashboard at any time during the archive period; reactivation re-processes your original file and typically completes within minutes. Audience questions, conversations, and contacts associated with the presentation are not affected by archiving.
4. Permanent deletion of inactive presentations. If an archived presentation remains inactive for ninety (90) consecutive days from its last activity, it will be permanently deleted, including the original uploaded file. We will send a further notice before permanent deletion occurs. Permanent deletion cannot be undone, and PresEngage has no obligation to retain or recover permanently deleted Presenter Content. Aggregate, non-identifying usage statistics (for example, total question counts) may be retained.
5. Deleting a presentation yourself. You may permanently delete any presentation from your dashboard at any time. Before deletion, the Services will show you exactly what will be removed. Deleting a presentation permanently removes: the original uploaded file; all generated slide images, text, and AI content; all audience questions and conversations for that presentation; and its share links and QR codes (which stop working immediately). Presenter-initiated deletion is immediate and irreversible.
6. Audience contact information after deletion. Audience members who provide their contact information through your presentation do so under PresEngage’s own Privacy Policy and consent, in addition to any relationship they have with you. When a presentation is deleted, associated audience contact information is retained only as long as needed to complete any email communications those audience members consented to receive (not to exceed twenty-one (21) days after their consent), and is then removed. Records needed to honor unsubscribe and do-not-contact requests are retained indefinitely as required by applicable law, including the CAN-SPAM Act.
7. Your responsibility to export. You are responsible for maintaining your own copies of any presentation files or content you wish to preserve. The Services are not a backup or archival service, and you should not rely on them as the sole repository of your materials.
8. Account closure. If your account is closed or terminated, your presentations are treated as deleted under paragraph 5 above, and audience contact information is handled under paragraph 6 above.
9. Changes. We may adjust the retention periods in this section prospectively. If we shorten a retention period, we will provide reasonable advance notice.

Temporary Interruptions

You acknowledge that temporary Site interruptions may occur beyond our control. We assume no responsibility for delays, misdeliveries, or technical issues.

Payment

This Site does not process credit card transactions. Payments are handled through third-party providers. We are not responsible for any payment-related disputes or issues.

Third-Party Sites & Information

Our Site may contain links to third-party websites. We are not responsible for the accuracy, legality, or policies of such third parties.

Content Ownership

All content on this Site, including text, graphics, logos, and software, is the property of PresEngage® or its affiliates and is protected by intellectual property laws.

Limitations on Use of Content

Except for personal use, you may not copy, modify, or distribute Site content without written permission. Unauthorized use may result in legal action.

Privacy & Security

By using this Site, you agree to our Privacy Policy. You are responsible for maintaining your account security and protecting your login credentials.

Advertising

We advertise the Services on third-party platforms, and our website and presenter application carry advertising tags from those platforms for that purpose. What those tags collect, who receives it, and how to opt out are described under “Advertising and Remarketing” in our Privacy Policy. Advertising tags are not used on the audience Q&A experience, and the limited extent to which audience analytics reaches an advertising platform is described there.

Disclaimer

This Site is provided “as is” without warranties of any kind. We do not guarantee that content will be error-free, uninterrupted, or meet your expectations.

Messaging Terms (SMS and WhatsApp)

PresEngage provides an AI-powered SMS Q&A support service that allows audience members to ask questions about presentation content and receive real-time responses via text message. You may also receive presentation materials, slide downloads, and feedback requests from the presenter. Messages are transactional and support-related.

• Message frequency varies. You will receive a response each time you text a question. Presenters may also send occasional broadcast messages with presentation materials or feedback requests.
• Message and data rates may apply.
• To opt out of text messages, reply STOP to cancel. To get help, reply HELP for help or email tos@presengage.com.

WhatsApp. Some presentations offer a WhatsApp Q&A in addition to, or instead of, SMS. Where they do, these Messaging Terms apply to WhatsApp in the same way they apply to text messages, with two differences. First, WhatsApp messages are carried over the internet by Meta rather than by a mobile carrier, so carrier message and data rates do not apply and WhatsApp’s own terms and privacy policy govern your use of WhatsApp itself. Second, message frequency and delivery are subject to WhatsApp’s platform rules, which may prevent us from replying outside an active conversation. You may end the conversation at any time by replying STOP.

Opt-In

PresEngage SMS Q&A Support (Presengage, Inc.): By scanning this QR code and texting PresEngage, you opt in to receive AI-powered support messages answering your questions about this presentation. You may also receive presentation materials and feedback requests from the presenter. Message frequency varies based on your questions. Message and data rates may apply. Reply HELP for help. Reply STOP to cancel. AI-generated answers are based on presentation content; accuracy is not guaranteed — verify critical information with the presenter. Misuse, including spam or harassment, may result in restricted access. PresEngage and the presenter are not liable for claims, damages, or losses arising from your use of this service or reliance on responses. Limitation of Liability

PresEngage® and its affiliates are not liable for any damages arising from your use of this Site. Your sole remedy for dissatisfaction is to stop using the Site.

Indemnification

You agree to indemnify and hold PresEngage® harmless from any claims, liabilities, or expenses arising from your use or misuse of this Site.

Termination of Use

We reserve the right to terminate your access to the Site at any time, for any reason, without notice.

Governing Law

These Terms are governed by the laws of the State of Delaware, and any disputes shall be resolved in local courts.
